Terms of Use

1. Purpose and scope

The Site is published by Kadris (hereinafter “the Publisher”). These Terms of Use (hereinafter “ToU”) define the terms and conditions under which any internet user (hereinafter “User”) accesses and uses the Kadris website (hereinafter “the Site”).
Access to, browsing and use of the Site imply full, complete and unreserved acceptance of these ToU.
In case of disagreement with one or more provisions, the User must immediately cease all use of the Site.

The Site also offers artistic works for sale online, in accordance with the Terms and Conditions of Sale accessible from the Site.

2. Access to the Site and availability

The Site is accessible free of charge to any User with internet access.
The Publisher strives to keep the Site permanently available but can in no way guarantee continuous, uninterrupted access.
The Site may be temporarily or permanently suspended for maintenance, updates, technical changes or force majeure.
The Publisher cannot be held liable for any interruptions or their consequences.

3. Authorised use and User obligations

The User undertakes to:

• use the Site in accordance with applicable laws and regulations;
• respect the intellectual property rights of the Publisher and third parties;
• not attempt to fraudulently access the Site's servers, databases or restricted features;
• not introduce, voluntarily or involuntarily, viruses, malware or any other code likely to disrupt the proper functioning of the Site;
• not use the Site to disseminate insulting, defamatory, discriminatory, hateful, obscene, political, religious or otherwise inappropriate content;
• not exploit information from the Site for commercial purposes not authorised by the Publisher.

Any breach of these commitments may result in the suspension or permanent removal of the User's access to the Site, without prejudice to possible legal action.

4. Intellectual property and third-party trademarks

4.1 Site content

All elements of the Site (texts, photographs, artistic creations, logos, design, layout, source code, databases, etc.) are protected by copyright and intellectual property rights.
Any reproduction, representation, modification, adaptation or distribution of the Site, in whole or in part, by any means whatsoever, without the express prior authorisation of the Publisher, is strictly prohibited.

4.2 Artistic works (wall frames)

The frames offered for sale are original works protected by the French Intellectual Property Code.
Any unauthorised reproduction, distribution or imitation is prohibited and may give rise to legal proceedings.

4.3 Third-party trademarks

The names, logos and trademarks mentioned on the Site remain the exclusive property of their respective owners.

The Site is an independent business, not affiliated with, sponsored or endorsed by the owners of these trademarks.

The works offered are independent artistic interpretations, inspired by existing cultural or automotive themes, and do not constitute official or licensed products.

5. Limitation of liability

The Publisher makes every effort to ensure the quality and reliability of the Site, but in no way guarantees:

• the absence of errors, omissions or inaccuracies;
• the accuracy, completeness or timeliness of the information published;
• the compatibility of the Site with the User's hardware or software;
• the absolute security of the Site against intrusions or hacking.

Consequently, the Publisher declines all liability for:

• direct or indirect damage suffered by the User in connection with the use of, or inability to use, the Site;
• loss of data, financial or commercial losses;
• damage caused by external hyperlinks or third-party site content.

6. Hyperlinks

The Site may contain links to third-party sites.
The Publisher has no control over these sites and cannot be held responsible for their content, operation or practices.
Creating links to the Site requires the prior written authorisation of the Publisher.

7. Personal data protection and cookies

Use of the Site may involve the collection of personal data.
The User is invited to consult the Site's Privacy Policy for details on the collection, processing and retention of their data.

The Site also uses cookies to improve the user experience.

8. Security

However, the User acknowledges that using the internet involves risks and that the Publisher cannot guarantee absolute security.

9. User-generated content

If the Site allows Users to publish reviews, comments or any other content:

• the User is solely responsible for the content they publish;
• the Publisher reserves the right to moderate, modify or delete any content deemed inappropriate, illegal, insulting, defamatory or infringing the rights of third parties.

10. No-warranty clause

The artistic creations offered on the Site are subjective interpretations.
They must not be confused with official products of the brands mentioned.
The User acknowledges that the works have no contractual or commercial link with the owners of third-party trademarks.

11. Force majeure

The Publisher cannot be held liable for non-performance or delay attributable to a force majeure event within the meaning of the law (natural disaster, war, strike, global internet outage, pandemic, etc.).

12. Amendments to the ToU

The Publisher reserves the right to amend these ToU at any time.
The new version takes effect as soon as it is published online and applies immediately to any subsequent use.

13. Applicable law and jurisdiction

These ToU are governed by French law.
In the event of a dispute, the competent courts will be those of the Publisher's registered office, unless mandatory legal provisions state otherwise.

This provision does not preclude the legal consumer protection rules provided for by the French Consumer Code.
